Boarding Agreement This contract is entered into between Canine Commissioner LLC (hereinafter referred to as the "Dog Trainer” or “Dog Training Company”) and I (hereinafter referred to as the "Dog Owner," "You,” or "Your"). BOARDING SERVICES The Dog Trainer agrees to provide the boarding services (hereinafter referred to as the "Services"): feeding, walking, and medication administration, using humane and ethical methods. The Dog Trainer uses the Balance Training Method, and uses correction collars (prong or e-collar). All training techniques used will prioritize the well-being of the dog, avoiding any harmful methods. The Dog Trainer will use training methods that suit the individual needs, temperament, and learning style of the dog but cannot guarantee a change in behavior. The Dog Trainer will offer guidance to the Dog Owner on how to implement these techniques in their daily interactions with their dog. DOG OWNER RESPONSIBILITIES The Dog Owner must provide information that is accurate to the best of their knowledge about their dog. If the dog has any known health issues or concerns, the Dog Owner must disclose these details to the Dog Trainer. It is the Dog Owner’s responsibility to inform the Dog Trainer of any health issues and provide the Dog Trainer with any required medications or supplements. If the Dog Owner fails to do so, they will be responsible for any medical expenses or damage to the property resulting from their dog’s health issues. The Dog Owner must provide the dog’s food for the duration of the stay. If the Dog Owner is not able to bring the food on the day of drop off, the Dog Owner may request that the Dog Trainer purchase the food for a $30 fee, plus reimbursement for the food. The Dog Owner must provide information that is accurate to the best of their knowledge about their dog. If the dog has any known behavioral issues or aggression triggers, the Dog Owner must disclose these details to the Dog Trainer. It is the Dog Owner’s responsibility to inform the Dog Trainer of any behavioral issues and whether the dog should be muzzled. If the Dog Owner fails to do so, they will be responsible for any medical expenses or damage to the property resulting from their dog’s misbehavior. PAYMENT AND FEES The Dog Owner agrees to pay the Dog Trainer the fees as follows for the Services. The service fee is currently set at $40.00 per day for the Boarding Program. The payment for the Services is due on or before the first day of Services, which is scheduled to begin on [Start Date]. If the payment is not made by the specified due date, a late payment fee of $150.00 may be charged. In the event of non-payment, the Dog Trainer reserves the right to withhold or terminate the Services. CANCELLATION AND TERMINATION To cancel or alter services without incurring a cancellation fee, the Dog Owner is required to provide written notice at least 3 days prior to the planned commencement date. If a cancellation is made after this period, a cancellation fee of $50.00 may be imposed. Either party may terminate this Agreement with written notice if the other party breaches any terms of the Agreement. Termination due to a breach will only be effective 2 days after the non-breaching party provides written notice unless the breach is rectified within that period. In the event of termination, any prepaid fees for sessions not yet conducted will be refunded on a prorata basis, excluding fees for completed sessions and any cancellation fees incurred up to the termination date. EMERGENCIES The Dog Trainer agrees to promptly report any incidents, accidents, injuries, or unusual behaviors observed during the training sessions. In the event of a pet medical emergency or illness during the training, the Dog Trainer will make every reasonable effort to contact the Dog Owner or their emergency contact immediately. If the Dog Owner or their emergency contact cannot be reached in time, the Dog Owner authorizes the Dog Trainer to seek emergency veterinary care for their dog if necessary for the dog's health, safety, and well-being. The Dog Owner agrees to reimburse the Dog Trainer for any reasonable and documented expenses incurred for emergency veterinary services. CONFIDENTIALITY The Dog trainer should keep all of the Dog Owner’s personal information strictly confidential and agrees not to disclose it to any third parties without written consent. LIABILITY The Dog Owner agrees to indemnify and hold harmless the Dog Trainer from any claims, liabilities, damages, expenses (including legal fees), or harm to the dog arising from the Services or breakage of the leash and other training equipment, except in cases of gross negligence or willful misconduct by the Dog Trainer. ENTIRE AGREEMENT This contract constitutes the entire agreement between the Dog Owner and the Dog Trainer regarding the Services and supersedes all prior discussions, understandings, representations, and agreements, both written and verbal. FORCE MAJEURE Neither party shall be held accountable for unforeseeable circumstances or events beyond their control, including acts of nature, government actions, war, epidemics, or other events hindering the contract’s performance. The affected party must promptly notify the other party and make reasonable efforts to mitigate the event's effects. SEVERABILITY If any provision of this Agreement is found to be invalid, illegal, or unenforceable under applicable law, the invalidity, illegality, or unenforceability of such provision shall not affect the validity or enforceability of the remaining provisions of this Agreement. I acknowledge that the Canine Commissioner LLC uses Balanced Training Methods and Correction Collars. I, hereby authorize Canine Commissioner LLC to use photographs and video recordings taken of my dog(s) during the Services for promotional, marketing, and advertising purposes, which may include but are not limited to website content, social media posts, newsletters, flyers, brochures, promotional videos, and other digital or print communications. I acknowledge that I will not receive any form of compensation or royalties for the use of these photographs and video recordings in promotional materials. I understand that while these photographs and video recordings may be used for promotional purposes, my personal information (such as my full name, contact information, and address) will not be disclosed or shared without my additional consent. I acknowledge that granting this consent is entirely voluntary, and I have not been coerced or pressured into providing permission for the use of my dogs’ photographs and video recordings. No modification, amendment, or alteration of this Agreement shall be binding unless it is made in writing and duly executed by both parties.
